List order (35=E) - why Tag 40 is not compulsory

15 Dec 2003 6:13AM ET I do not understand why the tag 40 (Order type) is no more compulsory in FIX protocol 4.2 for message order list (35=E)?
It used to be in FIX protocol 4.1.
Could someone give me an example for which it should not be sent?
