In your first query, I think the sell side is supposed to send an Ack before sending a fill. But its not a hard and fast rule. Its not required if the order is immediately rejected. If the client side is able to accept your fill er without a new er, then its fine. Regarding the Pending replace, it can be ignored if the replaced er is immediately sent.
Regarding your second query, I believe you have to send 2 er's as the buy side will not be able to see the partial fill in tag 31 & 32 if you send tag 39=5.
